Purpose

Children’s Medical Center (Children’s) is pleased to offer The Children’s Patient & Family Social Network. This is a private social network that is open to all current and past patients and families of Children’s Medical Center.
To register as a member, please go to Sign In on the childrens.com website in the top right Navigation or go to www.childrens.com/childrens-social-network and complete the online registration to establish your account.

The information provided on this Web site does not constitute an attempt to practice medicine, nor does the use of this site establish a doctor-patient relationship.   Always seek the advice of your physician or other qualified health care professional with any questions you may have regarding medical symptoms or a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on this Web site.

While the site attempts to remain current, health care information changes rapidly and this site should not be relied upon as comprehensive and error-free.  Children’s may revise the information on this Web site or otherwise change or update the Web site, including these Terms and Conditions, without notice to you. Children’s encourages you to periodically read these Terms and Conditions to see if there have been any changes to our policies that may affect you. Your continued use of the Web site will signify your continued agreement to these Terms and Conditions as they may be revised.

Children’s is not responsible for the content, security or the privacy practices of Third Party Web sites. Unless we specifically advise you otherwise, links to Third Party Web sites do not constitute or imply endorsement by Children’s of those sites, the information they contain or any products or services they describe. Privacy Information – General Portal

Any personal information you submit to the Web site is governed by the Children’s privacy practices. This includes information on your rights to see and receive copies of your personal health information. To the extent there is an inconsistency between these Terms and Conditions and the Children’s privacy practices, these Terms and Conditions shall govern.

In addition, although this Web site displays certain information from your medical record, it does not necessarily display all information found in your medical record. If you think that your medical record information displayed on the Web site is inaccurate, you can request that Children’s amend your medical record by mailing a request to the contact identified in your Notice of Privacy Practices. To request a complete copy of your medical record, make the request to the contact identified in your Notice of Privacy Practices.

Privacy Information – Children’s Patient Family Social Network

Any personal information, communication or material that you post/transmit to the site will be treated as non-confidential and non-proprietary, and not governed by the Children’s privacy practices.  Anything that you transmit or post may be used by users of the site for any purpose, including reproduction, disclosure, transmission, publication, broadcast, posting and market research.
Respect others’ privacy when using the Children’s Patient and Family Social Network as well as other Children’s social networking sites.  Do not post pictures of others without their permission. Do not post others health-related information for which you are not authorized to share. Provide consideration to others in the Children’s social network and refrain from slander, profanity, abusive or threatening comments.
Membership in Children’s Patient and Family Social Network is restricted to patients and family members of Children’s Medical Center. Employees of Children’s and physicians are ONLY allowed membership in Children’s Patient and Family Social Network if they are current or previous patients or family members of Children’s.
If you are an employee who is eligible to join Children’s Patient and Family Social Network and you choose to join the Children’s Patient and Family Social Network, you join as a patient or family member and NOT as a staff or employee. Any personal information, communication or material that you post/transmit to the site is posted as a patient or family member and NOT as a staff member or employee.  Any medical or professional knowledge that you have regarding other members in the Children’s Patient and Family Social Network that is based on your role as an employee of Children’s is governed by Children’s Privacy Practices.

Minor Eligibility

Unless otherwise allowed by law, an individual must be age 18 or older to request a personal account. Parents or guardians of minor children may request access to the minor child's account by following the terms outlined in the "Proxy Access" section of this Terms and Conditions statement.  Under State and Federal law, there may be circumstances where you will not be allowed access to your child’s health information.  Because of these legal requirements, Children’s reserves the right to deny you access as appropriate under the law.
Minor Eligibility-Children’s Patient and Family Social Network
Patients and family members who are 13 years of age and older may join Children’s Patient and Family  Social Network and create their own Profile and account. All Profiles are public and are age filtered into two separate groups.

This means that all patients and family members who are 13 years of age through 17 years of age are only allowed membership into the network group of patients and family members age 13-17 years old. All patients and family members who are 18 years of age and older are only allowed membership in the network group with patients and family members age 18 years old and older.

Messaging Privacy

Users of the Patient Portal should be aware that they may be notified via email, text or instant message when there is new medical information to be viewed.  This means that any person with access to your email, text or instant messages will be able to see this notification.  Although no private medical information will be sent, the notification that new medical information is available by accessing the Patient Portal may be information that you would not want others to know.  Thus, you should take this into account when providing Children’s any messaging address.

Children’s Patient & Family Social Network and Other Interactive Areas

Although Children’s may from time to time monitor or review any areas of the site where visitors transmit or post content, Children’s is under no obligation to do so.  Children’s assumes no responsibility or liability arising from the content of any such locations, or for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger or inaccuracy contained in any information contained within such locations on the site.  You are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material or material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law.  Children’s will fully cooperate with any law enforcement authorities or court order requesting or directing Children’s to disclose the identity of anyone posting any such information or materials.

You agree that you will not upload or transmit any communications or content of any type that infringe upon, misappropriate or violate any rights of any party.  This includes posting pictures of others without permission or referring to any other party’s health condition.

You agree that you will not upload or transmit any communications or content of any type that infringe upon, misappropriate or violate any rights of any party.

In consideration of being allowed to use Children’s Patient Portal, you agree that the following actions shall constitute a material breach of these Terms and Conditions:

  • signing on as or impersonating another person, or creating any false account information or health record for yourself or others
  • using the site in violation of local, state, national, international laws or Children’s Privacy Policy.
  • transmitting material that infringes or violates the intellectual property rights of others or the privacy or publicity rights of others
  • transmitting material that is unlawful, obscene, defamatory, predatory of minors, threatening, harassing, abusive, slanderous, or hateful to any person (including Children’s personnel) or entity as determined by Children’s in its sole discretion
  • advertising or solicitation of businesses
  • posting chain letters, pyramid schemes requests or petitions for signatures
  • using interactive services in a way that is intended to harm, or a reasonable person would understand would likely result in harm, to the user or others
  • intentionally distributing viruses or other harmful computer code

Children’s expressly reserves the right, in its sole discretion, to terminate a user's access to any or all areas of the site due to any act that would constitute a violation of these Terms and Conditions.  Additionally, Children’s failure to act with respect to a breach by you or others of these Terms and Conditions does not waive our right to act with respect to subsequent or similar breaches. 

Passwords

Children’s has several tools that allow you to record and store information. You are responsible for taking all reasonable steps to ensure that no unauthorized person shall have access to your site password or account. It is your sole responsibility to (1) control the disclosure and use of your activation codes and password; (2) authorize, monitor, and control access to and use of your Children’s online account and password; and (3) promptly inform the Children’s Web manager of any need to deactivate a password.

Limitations on Warranties, Liability and Damages

Your use and browsing of the Site is at your risk. Neither Children’s nor any other party involved in creating, producing, or delivering the Site is liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, the Site. Children’s neither warrants nor represents that your use of the materials displayed on the site will not infringe rights of third parties.  This site may also contain information posted by others, where Children’s does not have any control.  Children’s assumes no liability or responsibility for any errors or omissions in the content on the site. 

Without limiting the foregoing, everything on the Site is provided to you "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Please note that some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. Except as otherwise indicated, content on this site, including text, graphics, logos, button icons, photos, images, forms, audio, video, questionnaires, and software, is the property of Children’s or its licensors and is protected by United States and international copyright laws. This material may not be used except as provided (a) in these Terms and Conditions or (b) in the relevant text on the site, as applicable. 

Any rights not expressly granted by these Terms and Conditions or any applicable end-user license agreements are reserved by Children’s. Content and features are subject to change or termination without notice in the editorial discretion of Children’s.

The Digital Millennium Copyright Act of 1998 (the "DMCA") provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. Since the Site may be accessed from sources internationally where Children’s does not do business, Children’s does not represent that it is doing business in all such areas, or that its products or services will be available in any particular country or jurisdiction. Physician Contribution

Physicians who contribute information to this website are not employees of Children’s but are either members of Children’s medical staff and/or employees of other institutions.
